The former personal attorney for Donald Trump has resigned as the chief federal prosecutor in the state. This decision was prompted by a court battle that questioned her legal standing to serve.

Attorney General's Statement

The head of the Justice Department, Pam Bondi, announced her stepping down on Monday. She commented that the appeals court finding made it "untenable" for Habba to effectively run her office.

"Let no one confuse following the order as giving up," she wrote. "This battle will now stretch across the country."

Habba's exit follows closely on a US appeals court determined that she had been serving in violation of the law as US attorney. This ruling is could influence scores of legal proceedings in the Garden State.

The judicial panel ruled that a acting appointment that did not receive confirmation by the US Senate breached the statute on vacant positions.

The Attorney General added that Habba will stay on at the DOJ as a high-level advisor. Habba plans to pursue additional appeals of the ruling, in the hope of achieving a reversal.

In a statement, she argued that judges "must not countermand the President's choice of attorneys tasked with carrying out the fundamental role of the presidency of criminal prosecution."
