A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer alien smuggling charges, he was detained in federal detention.

In her decision, the court noted that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
